Terms of Service

These terms govern your use of The Executive. The two that matter most: the app is a tracking and organisation tool, not financial or medical advice — and nothing here takes away the rights you have under Australian Consumer Law.

1. Agreement

By creating an account or using The Executive, you agree to these terms. If you do not agree, do not use the service. These terms are between you and Joshua Extra (ABN 75 885 010 380), a sole trader of Queensland, Australia ("we", "us").

Our Privacy Policy forms part of these terms.

2. What the service is

The Executive is a personal dashboard for tracking wealth, health and daily performance. You enter your own information; the app organises, calculates and displays it, and offers optional AI-generated summaries and suggestions.

It is a record-keeping and organisation tool. It does not connect to your bank accounts, execute transactions, hold money, or manage investments on your behalf.

3. Not financial advice

We are not licensed to give financial advice and we do not give it. We do not hold an Australian Financial Services Licence.

Everything the app shows you — including net worth figures, forecasts, portfolio views, tax estimates, dividend projections and anything written by the AI Advisor — is general information based on the data you entered. It does not take account of your objectives, financial situation or needs, and it is not a recommendation to buy, sell or hold any financial product.

Before acting on anything you see here, consider getting advice from a licensed financial adviser, accountant or tax agent. Tax calculations in particular are estimates and are not a substitute for advice from a registered tax agent.

4. Not medical advice

The Executive is not a medical device and does not provide medical advice. Body metrics, workout data, supplement tracking and any related AI output are for general wellbeing tracking only.

Do not use the app to diagnose, treat or manage any medical condition. Speak to a qualified health professional before starting any exercise, supplement or dietary programme, and never disregard professional medical advice because of something you read here.

5. AI-generated content

AI features are powered by third-party language models. They can be wrong, incomplete or out of date, including about market data and tax rules. Always verify anything important before you act on it. You are responsible for the decisions you make; we are not responsible for AI output you rely on without checking.

AI features are subject to fair-use rate limits so the service stays available to everyone.

7. Subscriptions and billing

The Executive offers a free tier and a paid Pro subscription. Pro unlocks the AI Advisor, Invest, Tax, Learn and Services features.

Prices are in Australian dollars and include GST. Payments are processed by Stripe; we never see or store your full card details. We can provide a tax invoice on request.

Subscriptions renew automatically at the then-current price until you cancel. We will give you at least 30 days' notice by email before any price change affects you, and you can cancel before it takes effect.

8. Cancelling and refunds

You can cancel at any time from the Profile page. Cancellation stops future billing; your Pro access continues until the end of the period you have already paid for. We do not automatically refund the unused part of a period.

Your data is not deleted when you cancel — you keep access to the free tier and your history stays intact.

Your Australian Consumer Law rights are not affected. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. If the service has a major failure, you are entitled to a refund or to cancel, and to compensation for any other reasonably foreseeable loss or damage. If the failure is not major, you are entitled to have the problem fixed within a reasonable time.

If something has gone wrong, email support@the-executive.vip before anything else. We would rather fix it or refund you than argue about it.

9. Acceptable use

Do not: use the service unlawfully; attempt to access another user's data; probe, scrape or reverse-engineer the service; circumvent rate limits, paywalls or security controls; resell or redistribute the service; or upload anything malicious. We may suspend or terminate accounts that do.

10. Your data and our software

Your data is yours. You keep all rights to the information you enter. You grant us only the limited permission needed to store, process and display it back to you, and to provide the features you use — as described in the Privacy Policy. You can export it or delete it at any time.

The software is ours. The Executive, its name, design, branding and code remain our property. These terms do not transfer any ownership in them to you.

11. Availability

We aim to keep the service running continuously but we do not guarantee uninterrupted availability. Maintenance, third-party outages and faults happen. We may change, add or remove features over time; if we remove something significant that you are paying for, we will tell you and offer a fair remedy.

12. Liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

Subject to that, and to the maximum extent permitted by law: the service is provided "as is"; we are not liable for indirect or consequential loss, lost profits, lost data, or losses arising from financial or health decisions you make using the app; and our total liability to you in any 12-month period is limited to the amount you paid us in that period.

13. Termination

You may stop using the service and delete your account at any time. We may suspend or terminate your account if you materially breach these terms, or if we are required to by law. If we terminate your account without cause, we will refund the unused portion of your subscription.

If we discontinue the service entirely, we will give you at least 60 days' notice and a means to export your data.

14. Changes to these terms

We may update these terms. If a change materially affects your rights, we will email you at least 30 days before it takes effect. Continuing to use the service after that means you accept the updated terms. If you do not accept them, you may cancel.

15. Governing law

These terms are governed by the laws of Queensland, Australia. Disputes are subject to the non-exclusive jurisdiction of the courts of Queensland and the courts able to hear appeals from them.
